1. Acceptance of Terms

By using Last Ping ("the Service"), you agree to these Terms of Use. If you do not agree, do not use the Service.

2. Description of Service

Last Ping provides a health-check monitoring service that sends periodic emails to users and, if not confirmed within a user-configured timeframe (1-30 days), automatically delivers pre-configured encrypted messages ("secrets") to designated recipients.

3. User Responsibilities

You are solely responsible for:

• The content of your secrets
• The accuracy of recipient email addresses
• Ensuring recipients are authorized to receive your secrets
• Responding to health check emails in a timely manner
• Maintaining the security of your account

4. NO LIABILITY - IMPORTANT

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND.

Last Ping, its operators, and affiliates SHALL NOT BE LIABLE for:

• Failed delivery of health check emails or secret reveals
• Premature or delayed delivery of secrets
• Unauthorized access to your account or secrets
• Any damages resulting from disclosure of secrets to recipients
• Email delivery failures due to spam filters, provider issues, or other technical problems
• Loss of data, including secrets, recipient information, or account data
• Consequences of secrets being delivered or not delivered to recipients

5. NO WARRANTIES

We make NO WARRANTY that:

• The Service will be uninterrupted or error-free
• Emails will be delivered successfully
• Encryption will prevent all unauthorized access
• The Service will meet your specific requirements

6. User Authorization

By using the Service, you explicitly authorize Last Ping to:

• Send emails on your behalf to your designated recipients
• Automatically decrypt and transmit your secrets if you fail to respond to health checks
• Store your encrypted secrets and recipient information

7. Payment Terms

The Service is provided as a paid subscription at $6 per month or $60 per year. You may cancel at any time through the billing dashboard. Refunds are not provided for partial months.

8. Termination

We reserve the right to terminate your account at any time for any reason, including violation of these Terms. Upon termination, all secrets and data will be permanently deleted.

9. Limitation of Liability

IN NO EVENT SHALL LAST PING BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PRECEDING 12 MONTHS.

10. Indemnification

You agree to indemnify and hold harmless Last Ping from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Governing Law

These Terms are governed by the laws of the European Union and the jurisdiction in which Last Ping operates.

12. Changes to Terms

We may modify these Terms at any time. We will notify users of significant changes via email. Continued use of the Service after changes constitutes acceptance of modified Terms.
